Biography

Ms. Lipton has experience in drafting and negotiating executive employment agreements and assists in advising clients in the many aspects of employee benefits law, including the design and ongoing administration of benefit plans and programs. In addition, she regularly counsels clients on issues relating to personnel manuals, non-competition agreements and discrimination laws. Ms. Lipton also provides training to companies in the areas of sexual harassment prevention and diversity.

Ms. Lipton has defended clients in the Massachusetts Commission Against Discrimination against claims of religious discrimination and retaliation. She has also defended clients in court against claims arising under the Massachusetts Wage Act and prosecuted claims of sexual discrimination and retaliation in Federal Court.

Representative Matters
• Assisted in representing a plaintiff neurosurgeon in claims of hostile work environment and retaliation. After a seven-week jury trial in federal court, the plaintiff prevailed and was awarded a multi-million dollar judgment.

• Assisted in the successful representation of the Massachusetts Bay Transportation Authority in Neighborhood Association of the Back Bay v. Federal Transit Administration and Massachusetts Bay Transportation Authority. On September 14, 2006 the Court of Appeals for the First Circuit upheld the MBTA's plans for wheelchair accessible elevators at the Copley Green Line station. The plaintiffs had challenged the design and location of the elevators on the ground that they violated the National Historic Preservation Act, because of their effect on National Landmarks. This is the first appellate decision that deals with the tension between the historic preservation statutes and the Americans With Disabilities Act's mandate to transit systems that they make their stations accessible to people with disabilities.

• Assisted in representing plaintiffs in Rhodes v. AIG Domestic Claims et. al, Suffolk County Business Litigation Session, three-week bench trial resulting in judgment of willful violation of Chapter 93A and unfair insurance practices, award of multiple damages and $1 million in attorneys fees and costs.
