Biography

Ms. Pinarchick’s practice focuses on the efficient resolution of complex commercial and civil disputes. Her clients include privately and publicly held companies, financial institutions and professional firms as well as individuals. Ms. Pinarchick is also very active in the bankruptcy arena where she represents clients in a wide variety of bankruptcy related litigation.

Representative Matters

Bankruptcy
Routinely represents secured lenders and other creditors in bankruptcy related litigation including plan confirmation hearings, cash collateral and KERP motions, valuation proceedings and related motions. She has also represented various former officers and directors of debtors. Ms. Pinarchick was recently successful in lifting an automatic stay on the use of insurance proceeds from the debtor’s directors and officers liability policy which allowed her client to receive the cost of defending the adversary proceeding from the proceeds of the policy.

Employment
Routinely represents employers as well as officers, directors and employees in the negotiation, preparation and enforcement of employment, severance, non-disclosure and non-compete agreements and provides advice on a variety of employment related issues. She was recently successful in limiting the scope of a non-compete agreement between current employees of her client and their former employer so as to permit the employees to continue to work for her client.

Professional Malpractice
Effectively prosecuted and defended accounting malpractice actions. She recently obtained a favorable result for an accounting firm in a professional malpractice case brought by a public utility involving complex state and federal tax issues.

Non-Competition/Trade Secret Litigation
Successfully defeated attempts to impose a preliminary injunction prohibiting her client from utilizing alleged trade secrets. The case was appealed to the United States Court of Appeals for the First Circuit where the decision was upheld.

Joint Venture/Licensing Disputes
Successfully represented a leading technology company in various disputes arising out of failed joint venture initiatives and related licensing agreements.

Products Liability/Toxic Tort Litigation
Represented a Fortune 500 company nationwide in lawsuits arising out of beryllium exposure. Ms. Pinarchick effectively forced the voluntary dismissal of the case pending in Massachusetts.

Civil Litigation
Obtained a favorable settlement for the family of young woman who was murdered in a high profile civil action against various third party defendants.
